Binding origin information

A Binding Origin Information (BOI) is the written, binding answer from a customs authority to an economic operator that wants to determine the origin of a product. The economic operator can submit a request for such a decision, which must contain a detailed description of the nature and composition of the good. Depending on the applicable origin rules, more information must be provided in the application, such as the manufacturing method, the value ratios between the different materials and the tariff codes of the materials used (Combined Nomenclature–CN), etc.

  • Basic conditions

    • EORI number compulsory ;
    • the application :
    1. must be submitted in writing and in sufficient detail ;
    2. refers to an actual intended import/export movement ;
    3. mentioning the code of the row materials and of the final product (CN) ;
    4. clarifies the preferential or non-preferential origin ;
    5. mentions the relevant free trade agreements or unilateral measures, in the case of preferential origin.
  • Period

    A BOI decision is valid for 3 years.
  • Points of particular attention

    • Can apply to preferential as well as non-preferential origin ;
    • The declared goods must correspond to the goods described in the BOI ;
    • The decision is only binding upon the holder ;
    • The decision shall relate to only one type of goods and one type of circumstances for the determination of origin ;
    • Applications for BOIs regarding non-preferential origin must be submitted to the Federal Public Service Economy.
